Buying & Selling a Home

 

It’s a very exciting time when buying or selling your home and our highly experienced residential conveyancer will advise you which surveys and land registry searches are necessary depending on the location of the property.

We will also keep you informed in every step of the buying process and make sure that there are no unnecessary delays by liaising directly with your mortgage lender, estate agent and the sellers Solicitor.

Re-Mortgaging

 

If your current mortgage is coming to an end you may wish to re-mortgage with new mortgage lender.  You may also wish to release some capital from your property to fund home improvements, help your children to get on the property ladder or you may simply  wish to re-mortgage your property to take advantage of more attractive interest rates. 

It is important to seek independent legal advice on the implications and conditions of the re-mortgage.  We will make sure that you fully understand the terms of your new mortgage and will check the conditions set by your lender. 


Leasehold & Shared Ownership

Shared ownership schemes can have complicated leases, so it is important that you are fully aware of the terms in the scheme structure before you sign up. When it comes to selling your shared ownership property you must adhere to a set procedure, notifying your Housing Association and giving them first refusal to buy the property.

Dundas Law will make sure that you understand what your options are under your particular scheme and will advise you accordingly to help you secure your very important first home. 


Following a divorce or separation, co-owners of a property may need to change the ownership arrangement. Whether this is as a result of a court order or by voluntary agreement, the transfer of equity is a legal transaction that should be completed by a licensed conveyancer.

Permission will have to be sought from your mortgage company and any other secured lenders. The transfer must be registered at the land registry to be binding.

Dundas Law can negotiate with your mortgage lender for consent to transfer and release from mortgage obligations depending on your circumstances. We make sure that the conditions of your divorce or separation agreement are met and evidence is provided to the court.
